These general terms and conditions take precedence over any general terms and conditions of business of the other party.<\/p>\n\n\n\n<p>These terms and conditions are subject to change. The general terms and conditions in force at the time the order is placed shall apply to the contract.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 2&nbsp;: Ordering and concluding the contract<\/strong><\/h3>\n\n\n\n<p>Only persons of legal age and with full civil rights may place an order via the website.<\/p>\n\n\n\n<p>After placing an order via the website, the purchaser will receive an order confirmation by email, which corresponds to the acceptance of Du Rh\u00f4neChocolatier SA to conclude the contract.<\/p>\n\n\n\n<p>The sales contract binds the purchaser to Du Rh\u00f4ne Chocolatier SA, Rue du Rh\u00f4ne 118, Geneva.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 3&nbsp;: Prices<\/strong><\/h3>\n\n\n\n<p>Prices are in Swiss francs (CHF), including VAT and excluding delivery costs.<\/p>\n\n\n\n<p>The prices displayed on the website on the day of the order are decisive for the contract. No reimbursement will be made in the event of a change in the prices displayed between the date of the order and delivery.<\/p>\n\n\n\n<p>Du Rh\u00f4ne Chocolatier SA may change its prices at any time and without notice.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 4&nbsp;: Shipping costs<\/strong><\/h3>\n\n\n\n<p>Postage costs are payable by the purchaser.<\/p>\n\n\n\n<p>In the case of partial deliveries (art. 9), delivery costs will only be invoiced once.<\/p>\n\n\n\n<p>The buyer is required to provide precise information when entering his\/her contact details (street, number, email address, postcode, town, country, any necessary codes).<\/p>\n\n\n\n<p>In the event of return of the parcel(s), Du Rh\u00f4ne Chocolatier SA may invoice the purchaser for the related costs.<\/p>\n\n\n\n<p>For parcel delivery rates and for deliveries abroad, please refer to the delivery conditions (art. 5).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 5&nbsp;: Terms of delivery<\/strong><\/h3>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Our delivery conditions in Switzerland for private customers<\/strong><\/h4>\n\n\n\n<p>Delivery in Switzerland is free of charge for all orders over CHF 75.<\/p>\n\n\n\n<p>For orders of less than CHF 75, a delivery charge of CHF 9.50 will be applied to your order.<\/p>\n\n\n\n<p>Once the order has been processed by our teams, it is handed over to Swiss Post, who will manage the delivery of the parcel.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Our terms of delivery in Switzerland for businesses<\/strong><\/h4>\n\n\n\n<p>Quantity orders for companies must be placed by telephone or e-mail. For all enquiries, please contact us at : <a href=\"mailto:info@du-rhone.ch\">info@du-rhone.ch<\/a>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Our terms of delivery abroad<\/strong><\/h4>\n\n\n\n<p>International deliveries are possible, but you will be responsible for the delivery costs. In order to identify your needs and make you an offer, please contact us at the following address : <a href=\"mailto:info@du-rhone.ch\">info@du-rhone.ch<\/a>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 6&nbsp;: Taxes and customs duties<\/strong><\/h3>\n\n\n\n<p>Orders placed via the website by purchasers domiciled outside Switzerland may be subject to taxes and customs duties, which are imposed when the parcel reaches the recipient.<\/p>\n\n\n\n<p>These taxes and customs duties are the sole responsibility of the buyer. The purchaser is advised to contact the competent authorities of the country in which he\/she is domiciled before placing the order.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 7 : Payments<\/strong><\/h3>\n\n\n\n<p>Orders are paid for by credit card and Paypal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 8&nbsp;: Delivery times<\/strong><\/h3>\n\n\n\n<p>Du Rh\u00f4ne Chocolatier SA endeavours to process orders as quickly as possible. However, delivery times are given purely as an indication and are not binding.<\/p>\n\n\n\n<p>Any delay therefore does not give the purchaser any right to cancel the contract, refuse the goods or claim compensation or damages.<\/p>\n\n\n\n<p>Indicative lead times may be extended if obstacles occur for which Du Rh\u00f4ne Chocolatier SA is not responsible, such as force majeure, decisions by the authorities, natural phenomena, war, operational or transport problems, strikes, accidents, illness, as well as delayed, defective or faulty deliveries.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 9&nbsp;: Unavailability and partial deliveries<\/strong><\/h3>\n\n\n\n<p>If one or more items ordered are unavailable, Du Rh\u00f4ne Chocolatier SA will inform the customer by email, who will be offered the following choice:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>partial delivery, i.e. send the available items and put the unavailable product(s) on hold;<\/li>\n\n\n\n<li>modification of the order by cancelling the unavailable product(s);<\/li>\n\n\n\n<li>send the order only when all products are available.<\/li>\n<\/ul>\n\n\n\n<p>Please note that the credit card is debited when the order is validated. The credit card will therefore be debited even if one or more items cannot be delivered. In such a case, and if one or more products are completely unavailable, the relevant amounts will be refunded. If all the references in an order are unavailable, the amount and the delivery costs will be refunded in full.<\/p>\n\n\n\n<p>It is also specified that in the event of the temporary or definitive unavailability of one or more products, no compensation or damages are payable by Du Rh\u00f4ne Chocolatier SA.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 10&nbsp;: Risk transfer<\/strong><\/h3>\n\n\n\n<p>The risk passes to the buyer as soon as the contract is concluded, in accordance with Art. 185 of the Swiss Code of Obligations. Delivery is therefore made at the buyer&#8217;s risk.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 11&nbsp;: Guarantees<\/strong><\/h3>\n\n\n\n<p>Du Rh\u00f4ne Chocolatier SA only guarantees that the products delivered correspond to the products ordered in terms of quantity. Any other guarantee is expressly excluded by Du Rh\u00f4ne Chocolatier SA.<\/p>\n\n\n\n<p>If, on receipt of the products, the purchaser finds that the products delivered do not correspond to the quantities ordered, he must inform Du Rh\u00f4ne Chocolatier SA by email within 10 days of receipt of the order.<\/p>\n\n\n\n<p>Du Rh\u00f4ne Chocolatier SA will then send the purchaser a returns authorisation. The purchaser will have a period of 30 days from receipt of the authorisation to return the non-conforming products. If the products are not returned within this period, the purchaser will be deemed to have waived the right to return the products. Du Rh\u00f4ne Chocolatier SA will replace the returned products as soon as it receives them. If this is impossible or if the products are out of stock, the products that cannot be replaced will be reimbursed.<\/p>\n\n\n\n<p>Du Rh\u00f4ne Chocolatier SA accepts no liability for direct or indirect damage suffered by the purchaser and\/or the purchaser&#8217;s customers\/contractors in connection with the products delivered.<\/p>\n\n\n\n<p>All information relating to the products available on the website (in particular photos) may differ from the actual product and are therefore published without obligation.<\/p>\n\n\n\n<p>Du Rh\u00f4ne Chocolatier SA accepts no responsibility in the event that the products delivered do not comply with the legislation of the country of delivery, whether in terms of composition, ingredients, labelling or otherwise. It is the responsibility of the purchaser to ascertain whether the product ordered and the quantities allowed comply with the legislation of the country in which they are domiciled. No reimbursement or compensation will be granted if the products ordered are seized by customs. Any costs, taxes and fines relating thereto shall be borne exclusively by the purchaser.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Art. 12&nbsp;: Content and data on the website<\/strong><\/h3>\n\n\n\n<p>The data, photos, information, prices, descriptions, brands, etc. (hereinafter referred to as: data) appearing on the website are the exclusive property of Du Rh\u00f4ne Chocolatier SA.
